Our Terms and Conditions
1. Acceptance of terms
National Lottery Pix (“the Service”) is an on-line service which allows access to photographic or other images and on-line material in relation to The National Lottery (including, but not limited to, National Lottery trade marks, logos, logo guidelines and press releases) (“the Material”) provided by Camelot Group plc (“Camelot”), its licensors and third party content providers. By clicking on the [I Accept] link below, you agree to comply with these terms and conditions and acknowledge the Legal Disclaimer and Privacy Policy on this site (together “Terms of Use”).
If you do not agree with the Terms of Use or if you do not have the authority to accept the Terms of Use, please do not access or use any of the Material. Please note that any unauthorised use will constitute copyright infringement which is a prosecutable offence.
Camelot reserves the right to change, modify, add to or remove from the Terms of Use at any time. Your continued use of the Service following the notification of any changes will be understood to mean you have accepted them.
2. Access to the Material
Access to the Material is offered on a restricted password-protected basis. You will be able to access or download Material by entering a username and password. You will be able to change your password at any time following the on-screen instructions on the Service.
If at any time you are of the opinion that a new password is needed, then a request can be made to Camelot by following the on-screen instructions, and Camelot will, in its sole discretion, issue a new password [in writing.] To request this send an e-mail to [nationallotterypix@paratuscommunications.com].
You will receive an account designation upon completing the Service's registration process which includes your acceptance of the Terms of Use. You are responsible for maintaining the confidentiality of your username, your password and account, and are fully responsible for all activities that occur under your username, password or account. You may not share your username, password or account with anyone. You agree to (a) notify Camelot immediately of any unauthorised use of your username, password or account or any other breach of security.
In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form and (b) maintain and promptly update that information to keep it true, accurate, current and complete. If you provide any information which is untrue, inaccurate, not current or incomplete or Camelot reasonably suspects that you have provided, Camelot has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
Furthermore, Camelot has the right to suspend or withdraw temporarily or permanently your access to the Material at any time for any reason including (but not limited to):
• if you are in breach of the Terms of Use; or
• you (being a limited company) make any assignment for the benefit of creditors or make any compositions with creditors or if any action or proceeding under any insolvency law is taken against you and is not dismissed or if you shall effect a voluntary or compulsory liquidation of assets; or
• you (being an individual) are made bankrupt or convicted of a criminal offence involving fraud or theft; or
• Camelot is unable to provide access to the Service due to a defect in or failure of network, communication or computer systems owned or operated by Camelot or any third party.
Camelot cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 2.
3. Your Use of the Materials
Provided that you keep intact all copyright and other proprietary notices, you may print or download the Material on the Service (but not audio and audio-visual content) for your use ONLY in the normal course of your business which for the purpose of this licence will be limited to raising awareness of and/or promoting the National Lottery in the affiliate publication and on your website.
You must not:
• allow any third parties to use the Material without prior written consent from Camelot;
• engage in systematic retrieval of Material from the Service to create or compile, directly or indirectly, a collection, compilation, database or directly mirror on your own site, pages taken from the Service;
• use the Material for any purpose not expressly permitted in the Terms of Use;
• use the Material to promote any goods or services except the National Lottery;
• alter the photographic images or any data comprising the Material in any way whatsoever; or
• make the Material available for downloads.
In the event you download any Material from the Service in the course of your business for the purposes set out in this licence, such Material is sub-licensed to you by Camelot or its licensors. There is no transfer title to the Material to you. Camelot and its licensors reserve all rights not specifically granted to you.
In the event that you download any National Lottery logos, you must comply with the guidelines as to the reproduction of those logos, including colour and background treatment as specified with that logo.
4. Indemnity
You agree to indemnify and hold Camelot, and its licensors, affiliates, officers, agents and employees, harmless from any claim or demand arising out of your use of the Service, your connection to the Service, any breach of the Terms of Use and/or any act or omission by any person obtaining access to the Material by using your username or password, whether or not you authorise such access.
5. No resale of Service
You agree not to reproduce, duplicate, copy, sell, or resell any portion of the Service, use of the Service, or access to the Service.
6. General practices regarding use and storage
You acknowledge that Camelot may establish general practices and limits concerning use of the Service. You agree that Camelot has no responsibility or liability for the deletion or failure to store any messages and other communications or other Material maintained or transmitted by the Service. You acknowledge that Camelot reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that Camelot reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.
7. Modifications to Service
Camelot reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Camelot shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
8. Termination
You agree that Camelot, in its sole discretion, may terminate your account or use of the Service or any part of it, and remove and discard any Material within the Service, for any reason, including, without limitation, for lack of use or if Camelot believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Use.
Camelot may also, in its sole discretion and at any time, discontinue providing the Service, or any part of it, with or without notice. You agree that any termination of your access to the Service under any provision of the Terms of Use may be effected without prior notice, and acknowledge and agree that Camelot may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such information and files or the Service. Further, you agree that Camelot shall not be liable to you or any third-party for any termination of your access to the Service.
9. Links
The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Camelot has no control over such sites and resources, you acknowledge and agree that Camelot is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Material, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Camelot shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Material, goods or services available on or through any such site or resource.
10. Liability
Neither Camelot nor its licensors or any third-party content provider makes any warranty whatsoever including, without limitation, that:
• the operation of the Service will be uninterrupted or error-free;
• defects will be corrected;
• the Service, including the server that makes it available, is free of viruses or other harmful components; and
• any particular results may be obtained from use of the Material on the site; or
• any information, software, or service provided on or accessible from the Service will be accurate, reliable, available or of suitable quality.
Neither Camelot nor its licensors, affiliates or third party content providers shall have any liability to you in relation to any loss or damage that you suffer as a result of any delay or defect in or failure of the whole or any part of (or any combination of):
• your system; and/or
• the Internet; and/or
• any other network links or any other means of communication.
Neither Camelot nor its licensors, affiliates or third party content providers shall have any liability to you (whether in contract or in tort), including negligence) in the event that:
• any viruses, worms, software bombs or similar items are introduced into your system via the Service, provided that Camelot has taken reasonable steps to prevent such introduction; and/or
• the Service includes inaccuracies or typographical errors.
You will ensure that no computer viruses, worms, software bombs or similar items are introduced into the Service and will indemnify Camelot (in accordance with the "Indemnity" Section above) for any loss that Camelot suffers arising as a result of any such introduction.
All Material and information (including any third party information, products and content) included in or accessible from the Service are provided "as is" and without warranties of any kind (express, implied and statutory), all of which Camelot disclaims to the fullest extent permitted by law. Your use of the Service is at your sole risk.
In no event shall Camelot, its licensors, affiliates or third party content providers be liable for any direct, indirect, special, consequential or any other losses or damages of whatsoever kind arising out of or related to the use, inability to use, authorised use, performance or non-performance of the Service, even if Camelot was previously advised of the possibility of such damages and regardless of whether such damages arise in contract, tort, under statute, in equity, at law or otherwise.

Notices to you may be made via either e-mail or post. The Service may also provide notice of changes to the Terms of Use or other matters by displaying notices or links to notices.

‘The National Lottery’, the ‘Crossed Fingers’ logo, ‘National Lottery Pix’ and ‘Think Lucky’ are trade marks of the National Lottery Commission as are all National Lottery Game names and logos referred to on this site.
13. General information
The Terms of Use constitute the entire agreement between you and Camelot and govern your use of the Service, superseding any prior agreements between you and Camelot in relation to the Service. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software.
The Terms of Use and the relationship between you and Camelot shall be governed by the laws of England. The failure of Camelot to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision.
If any provision of the Terms of use is found by a court of competent jurisdiction to be invalid, you and Camelot nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the particular provision, and the other provisions of the Terms of Use remain in full force and effect.
You agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Use must be filed within one (1) year after such claim or cause of action arose.
The section titles in the Terms of Use are for convenience only and have no legal or contractual effect.
